Although these types of lawsuits can be complex and a little confusing, they also have many advantages for those who are struggling with the effects of a particular product, practice, or medication. Here are just a few of the advantages of these types of lawsuits.
For one thing, these lawsuits mean that the entire process of bringing a claim to court is less expensive. The legal system in the United States is designed not to give every plaintiff with a plea a huge amount of recompense but to bring the defendant to justice and to deter further harmful actions. Sometimes, plaintiffs who have a legitimate claim to justice don’t get it because they can’t afford to bring their case to trial. When a bunch of people band together for the same trial, though, each person has to pay less to get the case heard.
Along these lines, a class action lawsuit can often make trying cases with smaller claims worthwhile. Many times, the lawsuits that make the headlines end up with million dollar or more settlements. More often than not, though, the types of financial settlements that come down from major companies are pretty small. They can often be too small to justify taking a company to court in an individual lawsuit. When a class gets together, though, each person can get some recompense without having to spend that money and more getting the case to trial. This also makes a case worthwhile for a team of lawyers to take, since there will actually be a bit of money left over for them to get paid out of.
Finally, class action lawsuits can ensure that plaintiffs get equitable amounts of the overall settlement. Sometimes, what happens is that several people with nearly identical claims against a company or product will try their cases individually. Those who try their cases first may get awarded more money simply because at that point, the company has more money to pay. Once these trials are finished, though, the company may not have much left to pay to later plaintiffs who have similar claims against it. When a class action lawsuit is filed, the claim is paid to the entire class, and it’s then divided up equitably by the courts. This means that everyone gets his or her fair share of the money, and no one gets a pittance just because the defendant has run out of funds to pay the plaintiffs.
For all these reasons and more, class action lawsuits are often appropriate. They can be complex, but they can also help see that justice is served. Many times, these types of suits are the only way to change the behavior of a company or manufacturer who is causing serious problems.
